1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and MagicKite (“we”, “us”, “our”), governing your access to and use of the MagicKite website, applications, APIs, and generative video creation services (collectively, the “Service”).

By creating an account, accessing the platform, or purchasing a subscription or credit pack, you signify that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of the Service

MagicKite is a web-based artificial intelligence video and animation generation studio. The Service allows users to compose animated short films and digital video productions from text prompts, style selections, character choices, voice casting, and audio modes (including Narrator Mode and Cinematic Dialogue Mode).

Our automated backend engine renders visual scenes, synchronized dialogue, sound effects, subtitles, and composited video deliverables (“Films”) which are delivered digitally to your account dashboard for streaming and MP4 download.

3. Account Registration & Security

To use MagicKite, you must register an account using a valid email address. You must be at least 18 years of age (or the age of majority in your jurisdiction) to make purchases on the platform.

User authentication and account data storage are managed securely using Supabase. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Subscription Plans & Billing

Merchant of Record & Payment Processing: Our order process is conducted by our online reseller and Merchant of Record, Lemon Squeezy (lemonsqueezy.com / Sold through Link, LLC). Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy handles order transactions, secure payment processing, global tax compliance (including VAT/sales tax), and payment-related customer service inquiries and returns. MagicKite does not collect, receive, or store your credit card numbers or banking data.

Subscription Billing: MagicKite offers monthly subscription plans (Starter, Creator, and Pro). Subscriptions are billed in advance on a recurring monthly billing cycle starting on the date of your initial purchase. Your subscription will automatically renew at the beginning of each billing cycle unless cancelled prior to the renewal date.

Generation Credits: Each subscription tier grants a monthly allocation of generation credits:

• Starter Plan ($15/month): 130 credits per month
• Creator Plan ($49/month): 450 credits per month
• Pro Plan ($129/month): 1,400 credits per month
• Credit Top-Ups: $0.12 per credit

Credits refill monthly and do not roll over. Film generation costs 100 credits per minute (Narrator & Cinematic Modes at 480p) or 140 credits per minute (at 768p), and 30 credits per minute (Explainer Mode at 480p) or 45 credits per minute (at 768p). Credits are reserved when generation starts and refunded if generation fails.

Price Changes: We reserve the right to modify subscription fees. Any price changes will be communicated to you with at least 30 days prior notice, giving you the opportunity to cancel your subscription before new rates take effect.

5. Digital Delivery Policy

MagicKite provides instant electronic delivery for all digital products:

• Credit Allocation: Upon successful payment confirmation, your purchased generation credits are applied to your MagicKite account balance immediately (typically within seconds).
• Film Generation Delivery: Once an AI generation job finishes processing, the final video deliverable is delivered digitally inside your account dashboard under “My Films” where it is available for online streaming and high-definition MP4 download.

If your credits do not appear automatically after a completed checkout, please email [email protected] with your checkout email and order details for prompt synchronization.

6. Cancellation & Refund Policy

Refund Guidelines:

• 14-Day Unused Credit Refund Guarantee: If you purchased a subscription or credit package and have not consumed any generation credits from that billing period, you are eligible for a 100% full refund within fourteen (14) calendar days of purchase.
• Used Credits: Because generative AI video creation utilizes intensive, irreversible GPU cloud computing resources immediately upon initiating render jobs, credits that have already been consumed for video output are non-refundable.
• Technical Failures & Platform Defects: If a technical bug, pipeline interruption, or system defect causes your film generation to fail, your consumed credits will be automatically returned to your balance. If you remain dissatisfied due to a verified platform failure, you are entitled to a full or prorated monetary refund by reaching out to support.
• Refund Processing: All refund requests submitted to [email protected] are reviewed within 24 to 48 business hours. Approved refunds are issued directly back to your original payment method.
• Dispute Resolution: If you experience any billing discrepancies or issues with your order, please contact our support team at [email protected] directly before initiating a chargeback or payment dispute with your bank or credit card provider. We are committed to resolving billing issues swiftly and fairly.

7. Intellectual Property & Commercial Usage Rights

Commercial Rights for Subscribers: As a paid subscriber on any active plan (Starter, Creator, or Pro), you own all commercial rights to the completed digital video assets generated using your paid credits. You are entitled to broadcast, publish, monetize, and distribute these videos across commercial and social media channels (e.g. YouTube, TikTok, commercial marketing, presentations).

Compliance Requirement: Your commercial rights are conditioned upon your strict compliance with these Terms and our Acceptable Use Policy.

Platform Property: The MagicKite website, trademarks, branding, user interfaces, rendering software, and visual designs remain the exclusive intellectual property of MagicKite.

8. Acceptable Use Policy

Users must not use MagicKite to generate, upload, or transmit any illegal, harmful, harassing, abusive, defamatory, sexually explicit, hateful, or infringing material. MagicKite strictly prohibits NSFW content, deepfakes, harassment, and impersonation.

MagicKite reserves the right to reject content that violates safety standards and to suspend or terminate accounts engaging in repeated or egregious violations without a refund.

9. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER MAGICKITE NOR ITS SERVICE PROVIDERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO MAGICKITE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
